Legal bases of data processing

Insofar as we obtain consent for the processing of your personal data, Art. 6 para. 1 lit. a) DSGVO as the legal basis for data processing.

Insofar as we process your personal data because this is necessary for the performance of a contract or in the context of a relationship with you similar to a contract, Art. 6 para. 1 lit. b) DSGVO as the legal basis for data processing.

Data deletion and storage period

We always delete or block your personal data when the purpose for storing it no longer applies. However, storage may take place beyond this if this is provided for by legal requirements to which we are subject, for example with regard to statutory storage and documentation obligations. Use of our online offer

Information about your computer

Each time you access our online offer, we collect the following information about your computer, regardless of your registration: the IP address of your computer, the request of your browser and the time of this request. The purpose of reCAPTCHA is to verify whether the data entry on this website (e.g. in a contact form) is automated or whether a human being makes the corresponding data entry. We use “Zapier” to connect different web apps. This allows us to automate actions between different web apps. Zapier is a service of Zapier Inc, 548 Market St #6241, San Francisco, CA 94104, USA. When using Zapier, it is not excluded that data is transferred to servers of Zapier in the USA. We have concluded an order processing agreement with Zapier. In addition, the data processing is secured by the EU standard contractual clauses. We use Unbounce to create our landing pages. Unbounce is a service of Unbounce Inc. 400-401 West Georgia St. Vancouver, BC, Canada, V6B 5A1. The affected sites are hosted by Unbounce. Retargeting or remarketing are technologies that display suitable advertising to users who have previously visited a particular website, even after they have left that website. We use such technologies to place ads on the Internet. We use third-party providers for the placement of ads. We use your personal information for orders only within our company and affiliated companies as well as the company commissioned with the processing of orders.

Storage and data transfer for orders

For order processing we cooperate with various companies that are responsible for payment processing and logistics. In doing so, we ensure that our partners also comply with data protection regulations. Thus, we pass on your address data (name and address) to the respective transport company that delivers the ordered products to you. The legal basis for this is Art. 6 para. 1 lit. b) GDPR. The processing of your personal data is necessary for the fulfillment of the contract with you.

The data is stored by us for as long as it is required for the fulfillment of the contract. In addition, we store this data to fulfill post-contractual obligations and due to commercial and tax retention periods for the legally prescribed period. This retention period is usually 10 years to the end of the respective calendar year.

Payment processing for orders, Paypal

Depending on the selected payment method, payment processing for orders may be carried out by a service provider.

When paying by credit card, your necessary data such as name, address as well as the purchase data will be forwarded to the respective credit card company.

When paying via PayPal, you will be redirected to the Paypal website via a link. Personal data of you will be processed. These are your name, address, e-mail address, telephone number, if applicable, and account or credit card data. The legal basis for the payment processing is Art. 6 para. 1 lit. b) GDPR. The processing of your personal data is necessary for the performance of the contract with you, and you are free to choose the method of payment.

The data is stored by us for as long as it is required for the fulfillment of the contract. In addition, we store this data to fulfill post-contractual obligations and due to commercial and tax retention periods for the legally prescribed period. This retention period is usually 10 years to the end of the respective calendar year.

Credit check

Depending on the selected payment method, the check of your creditworthiness may be required. In this case, we use external service providers to whom we transfer your data (name, address, date of birth, order value) if you have given your consent to the credit check. We transmit the data to PayPal for this purpose.

The legal basis for the credit assessment is Art. 6 para. 1 lit. a) GDPR. If you do not wish to give consent to the credit check, you may have to select another means of payment.

As part of the credit assessment, an estimate is obtained of how high the probability of default is with regard to our receivable from the order. We only receive a probability value (score value) from our service provider, but no further details. Based on this value, we then evaluate whether the desired payment method can be offered. After the check has been completed, the score value is deleted by us and is not stored as part of the order data. It is therefore also not possible for us to evaluate retrospectively why, for example, a certain payment method was not possible.

Facebook Fanpage

In addition to our own online offering, we also operate a fan page on the social network Facebook. Through the fan page we inform about our activities and provide a channel for communication.

Delimitation of responsibility

Within the scope of the possibilities at Facebook, we try to ensure the protection of your privacy and your private data. Insofar as your personal data is processed by us in connection with your visit to the Fanpage, the explanations in this data protection declaration apply without restriction. Due to the integration of the fan page into the Facebook offer, it should also be noted that personal data is processed by Facebook at the same time. Facebook offers Fanpage operators the ability to get an overview of Fanpage usage and its users through the Page Insights features. Via Page-Insights, mainly statistical data can be called up and evaluated. We use the data from Page Insights to make the Fanpage as attractive and efficient as possible. For this purpose, Facebook provides us with data that Facebook itself has generated. Messenger

Facebook offers users who are registered with Facebook the possibilities for immediate communication via Facebook Messenger. If you contact us via the messenger, the transmitted data will be stored and used by us solely for the purpose of responding to your inquiry. The legal basis for the processing of your data is your consent within the meaning of Art. 6 para. 1 lit. a) DSGVO and our legitimate interest within the meaning of Art. 6 para. 1 lit. f) GDPR. Our legitimate interest lies in the collection and processing of customer inquiries, in the evaluation of customer inquiries as well as in abuse control.

The data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. For your personal data, this is the case when the respective conversation has ended. We consider the conversation to have ended when the circumstances indicate that the matter in question has been conclusively clarified. The user has the option to revoke his consent to the processing of personal data at any time; in this case, the data will be deleted immediately if there is no basis for further storage.

We use MailChimp to send our newsletter. MailChimp is a service provided by The Rocket Science Group, LLC, 512 Means Street, Suite 404, Atlanta, GA 30318 (hereinafter Mailchimp). The email addresses of our newsletter recipients, as well as the other data processed in the context of the newsletter dispatch, are stored on MailChimp’s servers in the USA. MailChimp uses the information provided and collected to send and evaluate the newsletters on our behalf. We have entered into a “Data Processing Agreement” with MailChimp. This is a contract in which MailChimp undertakes to protect the data of our users, to process it on our behalf in accordance with its data protection provisions and, in particular, not to pass it on to third parties.

MailChimp also provides various analytics about the extent to which the newsletters sent are opened and used, such as how many users an email was sent to, whether emails were rejected, and whether users unsubscribed from the list after receiving an email. The analyses are performed on a group basis and are not used by us for individual evaluation. The legal basis for the cooperation with MailChimp is Art. 6 para. 1 lit. f) DSGVO, unless you have given your express consent in accordance with Art. 6 para. 1 lit. a) GDPR is present. Our legitimate interest follows from the fact that we require the use of the service provider for the purpose of direct advertising and optimization of our offers.

If you no longer wish to receive newsletters from us, you can revoke your consent at any time with effect for the future or object to further receipt of the newsletter without incurring any costs other than the transmission costs according to the prime rates. Simply use the unsubscribe link included in each newsletter or send a message to us or our data protection officer.

Freshworks

Within the framework of customer relationship management, we make use of services provided by Freshworks Inc. 2950 S. Delaware Street, Suite 201 San Mateo CA 94403. The services here include FreshChat (live chat software). All the services facilitate our customer contact and make it more effective and customer-friendly. Within the scope of these services, customer data is collected, in particular with regard to any orders or service requests. Freshworks will act as an order processor for us and data processing will take place on the basis of our instructions. The EU standard contractual clauses were agreed with Freshworks. In the facilitated and more effective customer communication also lies our legitimate interest under Art. 6 para. 1 lit. f) GDPR. Furthermore, the legal basis for the corresponding data processing operations is Art. 6 para. 1 lit. b) GDPR, if the data processing is necessary for the performance of a contract or for the initiation of such a contract.

YouTube use

YouTube videos are integrated in our online offer, for the playback of which we use a plugin of the YouTube service operated by Google (“YouTube”). The operator of the service is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). We use the YouTube service in extended data protection mode to protect your privacy as much as possible. If you call up a web page of our online offer on which a YouTube video is embedded, Google initially only receives the information necessary for the integration and no cookies are set for usage analysis.
